The Marriage License

Where do you get one?

A couple who intends to be married in New York State must apply in person for a marriage license to any town or city clerk in the state. The application for a license must be signed by both the bride and groom in the presence of the town or city clerk. A representative cannot apply for the license on behalf of the bride or groom. This applies even if the representative has been given the Power of Attorney. Notarized marriage license affidavits signed by the bride or groom cannot be substituted for their personal appearance.



Is there a waiting period?

Yes. Although the marriage license is issued immediately, the marriage ceremony may not take place within 24 hours from the exact time that the license was issued. When both applicants are 16 years of age or older, the 24-hour waiting period may be waived by an order of a justice of the Supreme Court or a judge of the County Court of the county in which either the bride or groom resides. If either person is under 16 years of age, the order must be from the Family Court judge of the county in which the person under 16 years of age resides.

How long is the license valid?

A marriage license is valid for 60 days, beginning the day after it is issued.

How much does it cost?

If the marriage license is issued by a town or city clerk in New York State outside of New York City, it costs $40. This fee includes the issuance of a Certificate of Marriage Registration. This certificate is automatically sent by the issuing clerk to the applicants within 15 days after the completed license is returned by the officiant (person who performs the marriage ceremony). It serves as notice that a record of the marriage is on file. Couples who do not receive a Certificate of Marriage Registration within four weeks of the wedding should contact the town or city clerk who issued the license.

If the license is to be issued by the City Clerk of the City of New York, please contact the New York City Clerk's Office for current fees and requirements. The City Clerk's Office can be reached at (212) 669-2400 or via their web site at New York City Marriage Bureau.
Is a premarital physical exam required?

No premarital examination or blood test is required to obtain a marriage license in New York State.

What are the age and consent requirements for minors?

* If either applicant is under 14 years of age, a marriage license cannot be issued.
* If either applicant is 14 or 15 years of age, such applicant(s) must present the written consent of both parents and a justice of the Supreme Court or a judge of the Family Court having jurisdiction over the town or city in which the application is made.
* If either applicant is 16 or 17 years of age, such applicant(s) must present the written consent of both parents.
* If both applicants are 18 years of age or older, no consents are required.
* One parent alone may consent to a minor's marriage if:
o The other parent has been missing for one year preceding the application;
o The parents are divorced and the consenting parent was given sole custody of the child when the divorce decree was awarded;
o The other parent has been judged incompetent; or the other parent is deceased.
o Parents, guardians or other people consenting to the marriage of a minor must personally appear and acknowledge or execute their consent before the town or city clerk or some other authorized official. If the notarized affidavit is made before an official outside of the State of New York, it must be accompanied by a certificate of authentication when the consent is filed in New York State.

Proof of Age and Identity

A person is required to establish proof of age and identity by submitting to the issuing clerk one of the following age related documents:

1. Birth Certificate
2. Baptismal record
3. Naturalization record
4. Census record

And one of the following identity related documents:

1. Driver's license
2. Passport
3. Employment picture ID
4. Immigration record

Familial Restrictions

A marriage may not take place in New York State between an ancestor and descendant, a brother and sister (full or half blood), an uncle and niece or an aunt and nephew, regardless of whether or not these persons are legitimate or illegitimate offspring.

Previous Marriages

Information regarding previous marriages must be furnished in the application for a marriage license. This includes whether the former spouse or spouses are living, and whether the applicants are divorced and, if so, when, where and against whom the divorce or divorces were granted. A certified copy of the Decree of Divorce or a Certificate of Dissolution of Marriage may be required by the clerk issuing the marriage license.

Surname Options

Every person has the right to adopt any name by which he or she wishes to be known simply by using that name consistently and without intent to defraud. A person's last name (surname) does not automatically change upon marriage, and neither party to the marriage is required to change his or her last name. The bride and groom need not take the same last name.

One or both parties to a marriage may elect to change the surname by which he or she wishes to be known after the marriage by entering the new name in the appropriate space provided on the marriage license. The new name must consist of one of the following options:

* the surname of the other spouse;
* any former surname of either spouse;
* a name combining into a single surname all or a segment of the premarriage surname or any former surname of each spouse;
* a combination name separated by a hyphen, provided that each part of such combination surname is the premarriage surname, or any former surname, of each of the spouses.

The use of this option will provide a record of your change of name. The marriage certificate, containing the new name, if any, is proof that the use of the new name, or the retention of the former name, is lawful. The local Social Security Administration office should be contacted so that its records and your social security identification card reflect the name change. There is no charge for this service.

Whether you decide to use or not use this option at the time of your marriage license application, you still have the right to adopt a different name through usage at some future date. However, your marriage license cannot be changed to record a surname you decide to use after your marriage.

If you plan to use your married name at work, be sure to have your name changed in Social Security records. This way, you will get credit for all your earnings. It's easy and it's absolutely free. Contact any Social Security office. Look in the telephone book for the address and phone number. You will need documentary evidence showing both your old name and your new name.

Where can a marriage take place?

A New York State marriage license may be used within New York State only. Please note that if you go out of New York State to be married, your New York State marriage license will not be filed in New York State.
What about the ceremony?

There is no particular form or ceremony required except that the parties must state in the presence of an authorized member of the clergy or public official and at least one other witness that they take each other as husband and wife. There is no minimum age for a witness. However, in selecting a witness, choose at least one person who you feel would be competent to testify in a court proceeding as to what he or she witnessed.
Who can perform a marriage ceremony?

To be valid, a marriage ceremony must be performed by any of the individuals specified in Section 11 of the New York State Domestic Relations Law. These include:

* the mayor of a city or village;
* the former mayor, the city clerk or one of the deputy city clerks of a city of more than one million inhabitants;
* a marriage officer appointed by the town or village board or the city common council;
* a justice or judge of the following courts: the U.S. Court of Appeals for the Second Circuit, the U.S. District Courts for the Northern, Southern, Eastern or Western Districts of New York, the New York State Court of Appeals, the Appellate Division of the New York State Supreme Court, the New York State Supreme Court, the Court of Claims, the Family Court, a Surrogates Court, the Civil and Criminal Courts of New York City (including Housing judges of the Civil Court) and other courts of record;
* a village, town or county justice;
* a member of the clergy or minister who has been officially ordained and granted authority to perform marriage ceremonies from a governing church body in accordance with the rules and regulations of the church body;
* a member of the clergy or minister who is not authorized by a governing church body but who has been chosen by a spiritual group to preside over their spiritual affairs;
* other officiants as specified by Section 11 of the Domestic Relations Law.

The person performing the ceremony must be registered with the City of New York in order to perform a ceremony within the New York City limits. The officiant does not have to be a resident of New York State. Ship captains are not authorized to perform marriage ceremonies in New York State.
Where can I get copies of my records?

For copies of marriage licenses issued anywhere in New York State except the five (5) boroughs of New York City, a certified copy of the marriage record may be obtained from the office of the town or city clerk who issued the license, or from the New York State Department of Health. The fee is $10 if you obtain a certified copy from the town or city clerk who issued the license. If applying to the New York State Department of Health, the fee is $30. The video will record the wedding as it happens and it will capture more of the special moments that a still camera may miss. Smiles, laughs, body language, sweet words, and the divine commitments made in marriage will all be linked in a video. The verdict is... well it’s up to you. My verdict is that no wedding should be without a video and pictures no matter what the situation. They will make a wedding last a life time. My advice is make sure you use a professional for both your wedding video and your wedding pictures.

"That's the way I am."

One should recognise when he needs to make changes in himself and his actions and then begin to take the necessary steps towards those change. All of us need to change because in life, there is no growth without it.

It's not always pleasant. History is full of mankind's struggle against change. But you can't make progress without it. At one time in my life, I found it hard to change. I liked doing things the way I had always done them. I was comfortable with the way I was. But from the time I came to know Jesus and began to expose myself to inspirational teaching, I found myself changing and it wasn't as difficult as I thought. Several years ago in the mid-nineties, I heard Chris Oyakhilome say,

"If you want to grow, be quick to change."

I took that to heart and began to practice this in my life because I wanted to grow, I wanted to improve. Do you? Do you want your marriage to grow and improve? Then you need to be ready to make changes. Some of them might be difficult, some might be easy, but the results will always be beneficial.

Remember what we said about people saying that they are creatures of habit? Well for those who want to be happy in marriage and ensure that they don't make life miserable for their spouses, they may need to start forming new habits or be ready to adjust to a new way of doing things because like it or not, marriage is a different situation from the single life. Add children to the mix, and it means that you need to make a whole lot more adjustments. Don't be too rigid. The way you are may have worked for you while you were by yourself, but now that you're with someone else, things have to be different.

Because I had learnt this at a younger age, I made some effort to adjust to my new situation as a wife. My family was surprised when from a few minutes after the "I dos" I started responding to my young husband as the one whom I should listen to. He was now my husband and so he was the one in charge. Not my parents or older relatives. I remember one of them remarking on my wedding day, "Are you already treating Chuka as the one in charge?" I replied, "He's my husband, isn't he?" And he was, even though we had just been married a few minutes before, I knew that the situation had changed and I had to adjust to it.

Some people can see that you're changing because you're married now and may resist it. They want you to be the same way you always were. They may even tell you beforehand, "I hope marriage won't change you." And you might unwisely remark, "Don't worry, it won't." Well it should. You're no longer single, but married. That's a change in itself.

So look out for your single or divorced friends who will try to manipulate you into staying the same. I had a friend who kept on telling me, "you've really changed, you've really changed." And I felt bad about it for a while because our very close relationship wasn't the way it was before and I knew that she wasn't happy about it. Then I had an epiphany. When she made the same remark again to me one day, I said, "Yes I have changed, I'm married." We are still close friends. But our relationship isn't exactly the way it was before because a new situation requires new responsibilities, new accountabilities, and new habits.

How does change start? It starts with the mind. There can be no permanent positive change in your marriage or life without a change or adjustment in the way you think or see things. Are you ready? Can you do it?

King Solomon says, "As a man thinks in heart so is he."

Why does it start with the mind? Because we are pulled in the direction of our thoughts. Our lives are a reflection of the way we think. Our thoughts are shaped by the environment we grew up in, the friends we have, the people we listen to (books and the media), and the things that we give attention to. Some are short-term, meant to shed pounds over a limited period of time; others are long-term lifestyle changes. The success of these diet programs depend largely on the person's weight loss goals and level of commitment. Needless to say, if you just want to drop a dress size for your wedding, you may not be ready to go into something long-term. But if you have health problems, and need to control cholesterol levels, then a short-term solution would not be very effective.

Other weight loss programs are closely tied with exercise routines. Of course, not all exercise regimens will appeal to an individual; some would find yoga interesting, while others would prefer something like belly dancing. The idea is that one picks what is most interesting to them--the more fun and enjoyment they derive from a routine, the more likely they will stick to it.

The mistake that many people make is that they don't consider their own lifestyle or personality when they try a diet or exercise regimen; they go with what everyone else is doing, or jump on the weight loss bandwagon on the premise that it worked for so-and-so. While it's okay to experiment with different regimens (wouldn't hurt to try anything once), ultimately it is a search to find what is personally appealing.

Another secret to maintaining a diet or exercise regimen is to have very clear and realistic goals. "Be thin" is too general to be meaningful; pinpoint a number, and a date: "Lose 15 pounds by September." And to avoid discouragement, that goal must be humanly achievable and should never compromise with one's health. If a diet makes one dizzy, or radically affects one's ability to be fully alert and functional, then stop immediately.

If you are having your wedding reception out of doors, that opens the door for many activities that would be hard to pull off indoors. You can plan games and activities based on the outdoor theme and carry that theme indoors if part of the reception is inside as well.

Depending on where the reception will be held, you can plan many activities based on the setting. Whether it is the park or on a farm, there are a myriad of activities you can plan.

Let's start with some basics based on popular wedding locations. One fun game for a winery wedding is a blindfolded wine tasting game. If the bride and groom are wine drinkers, this might not a game the bride and groom should be a part of, but instead guests and wedding party members. Blindfold perhaps a half dozen volunteers and have them do a blind taste test (provide something to clean the palate between sips). The volunteers should guess which wine is the pinot noir, which is the Cabernet, and so on. A bottle of wine is the obvious prize for the winner of this game.

Say you are having a reception at a country club on a golf course. It's possible your theme will include golf elements, so why not include golf in some reception activities or games? You certainly could head to the golf course for a "hole in one" contest, or have a driving contest to see which guest has the best stroke. As a simple, "who gets the centerpiece game", you could have people guess how many golf balls there are in the floral centerpiece (which could decorate a plain large glass vase filled with flowers). Similarly, there could be a large vase or other clear container filled with golf balls at the reception somewhere and guests could guess how many golf balls are in the vase.

A silly game could be made on the dance floor by asking everyone to include their best golf swing into their dancing for one particular song.

Now, if your reception and ceremony are both to be held outdoors and guests will be milling outdoors, think about games or activities that can take place outdoors and still keep to your level of formality or informality. For example, if the reception is being held at a park, perhaps guests might enjoy a "walk down memory lane". Prior to the reception, someone can use potted plants or arbors to create a little private lane, which guests can walk through. Along the path, guests will find pictures of the bride and groom at various stages in their lives. There should be a place for guests to record their thoughts and memories along the way as well.

If your wedding and reception are fairly casual, you can always tell guests ahead of time to prepare for a ball game or some other fun outdoor activity. Women can bring a pair of sneakers. Just imagine the fun photos you'll get out of a rousing game of football or baseball played by women in dresses and sneakers and men in suits and sneakers!

You can provide a challenge activity involving barefoot dancing in the grass or a Frisbee toss in the backyard. Is there a pool in the yard where the reception will be held? Why not have a swimming activity for after the whole of the reception is done?
